『本票』本票和汇票的区别

票据(bill或note)是由出票人签发,约定自己或委托他人见票或于确定的日期,无条件支付一定金额的有价证券。我国票据法上的票据包括汇票、本票和支票。

支票(cheque或check)是出票人签发的,委托办理支票存款业务的银行或者其他金融机构在见票时无条件支付确定的金额给收款人或者持票人的票据,其英文释义为:an unconditional order in writing drawn on a Banker, signed by the drawer, instructing the Banker to pay on demand a sum certain in money to or to the order of a specified person or to Bearer and which does not order any act to be done in addition to the payment of money。

本票(promissory note)是出票人签发的,承诺自己在见票时无条件支付确定的金额给收款人或者持票人的票据,其英文释义为:A promissory note, sometimes referred to as a note payable, is a legal instrument (more particularly, a financial instrument and a debt instrument), in which one party (the maker or issuer) promises in writing to pay a determinate sum of money to the other (the payee), either at a fixed or determinable future time or on demand of the payee, under specific terms。

汇票(draft或bill of exchange)是出票人签发的,委托付款人在见票时或者在指定的日期无条件支付确定的金额给收款人或持票人的票据,其英文释义为A bill of exchange is a written order used primarily in international trade that binds one party to pay a fixed sum of money to another party on demand or at a predetermined date. Bills of exchange are similar to checks and promissory notes—they can be drawn by individuals or banks and are generally transferable by endorsements。

三者的主要区别如下:

首先:性质不同,支票、汇票为委托证券,本票为自付证券。即本票由自己支付,支票和汇票由第三方委托支付。

其次,基本当事人不同,支票和汇票有三个基本当事人,即出票人、付款人和收款人;而本票只有两个基本当事人,即出票人(实质上出票人和付款人为同一人)和收款人。

通过以上解释已经很好区分本票和支票、汇票的差别,接下来再来看一下支票和汇票之间主要的差别:

首先:付款人不同,支票的付款人必须是有支票存款业务资格的银行或非银行金融机构,汇票的付款人一般是银行。

其次,付款期限不同,支票的付款期限是自出票日起10天,汇票的付款期限是出票日起1个月。

最后,适用范围不同,支票只能在同城交换地区内的单位和个人之间使用,汇票在同城和异地都可以使用。
